1. Agreement to Terms

By downloading, installing, or using any mobile application provided by Spontaniti, including but not limited to QR Square, Curenci, and Discaltor (collectively, the "Apps"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Apps.

2. Use of the Apps

The Apps allow you to use various features such as scanning QR codes, converting currencies, or calculating discounts. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes, subject to these Terms.

You agree not to use the Apps for any unlawful purpose or in any way that interrupts, damages, or impairs the service.

3. Subscriptions and Payments

Some Apps may offer premium features ("Pro") available via auto-renewing subscriptions or one-time purchases.

  • Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Account Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package.
  • Management: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on the App Store or Google Play Store after purchase.
  • Free Trial: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.

4. Intellectual Property

The App and its original content (excluding user-generated QR codes), features, and functionality are owned by Spontaniti and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5. User Generated Content

You are solely responsible for the content (URLs, text, contact info, calculation data) you create, input, or generate using the Apps. We do not transmit or store the content you generate on our servers; it is processed locally on your device.

6. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's operation or content. We do not warrant that the App will be error-free or uninterrupted.

7. Limitation of Liability

In no event shall Spontaniti be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the App.

8. App Store Requirements (Apple Users)

If you downloaded any App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and Spontaniti, not Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to furnish any maintenance and support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  • Spontaniti, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims and intellectual property infringement claims.
  • You must represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.

9. EU Right of Withdrawal

If you are a consumer based in the EU, you normally have the right to withdraw from a contract within 14 days. However, by purchasing digital content (like a subscription) and starting the download or using the premium features immediately, you acknowledge and agree that you lose your right of withdrawal. Use of the App's premium features constitutes your express consent to immediate performance of the contract and waiver of the right of withdrawal.

10. EU Online Dispute Resolution

If you are a consumer based in the EU, you can use the European Commission's Online Dispute Resolution platform for settling disputes: https://ec.europa.eu/consumers/odr

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. You are advised to review this page periodically for any changes.
